On May 3, the Kaduna Regional Command of Nigeria's Economic and Financial Crimes Commission (EFCC) arraigned a man named Philip Yohanna before Judge Daruis Khobo of the Kaduna State High Court in Kaduna State on three criminal charges of breach of trust.
The accused allegedly received a 5 million naira (75,000 yuan) remittance from a victim named Zigwai Ayuba in 2021 to invest in forex trading, but he diverted the funds for his own use.
One of the charges reads as follows: "On or about May 21, 2021, Philip Yohanna was entrusted by Zigwai Ayuba with 500,000 Naira (RMB 7,500) to invest in foreign exchange transactions in Kaduna, which is under the jurisdiction of this Honor Court, but Philip Yohanna dishonestly converted it for his own use, And contravened section 296 of the Kaduna State Penal Code, 2017 and was punished under section 297 of the same law."
The second charge reads as follows: "On or about June 15, 2021, Philip Yohanna in Kaduna, under the jurisdiction of this Court of Honour, when entrusted by Zigwai Ayuba with 2.5 million naira (37,500 yuan) for investment in foreign exchange transactions, dishonestly converted it for your own use in breach of the agreement, Thereby contravening section 296 of the Kaduna State Penal Code and being punished under section 297 of the Act."
The defendant has pleaded not guilty to the charges.
In view of the defendant's plea, prosecution counsel KS Ogunnade requested a date for the hearing, while defence counsel BA Damshaki filed a bail application for the defendant.
Judge Khobo granted bail of 3 million naira and a surety of the same amount for the accused. The sponsor must be a civil servant below grade 12, preferably his father.
