The third branch of Baobao (Shanghai) Catering Management Co., Ltd. was fined 50,000 yuan for producing and operating food and food additives that are corrupt, rancid, mildewed, unclean, mixed with foreign bodies, adulterated or with abnormal sensory properties, according to a punishment recently released by the Shanghai Market Supervision Administration.
According to the penalty information, on February 18, 2022, a consumer ate two small pieces of transparent hard foreign bodies of about 2mm×4mm in the dish "Saicrab and Fengye dumpling" when eating at the business premises of Baobao (Shanghai) Catering Management Co., LTD.
Food Safety Law of the People's Republic of China Article 124 If any of the following violations of the provisions of this Law do not constitute a crime, the food safety supervision and administration department of the people's government at or above the county level shall confiscate the illegal gains, food and food additives illegally produced or operated, and may confiscate tools, equipment, raw materials and other articles used in the illegal production or operation; If the value of food or food additives illegally produced or marketed is less than 10,000 yuan, a fine of not less than 50,000 yuan but not more than 100,000 yuan shall also be imposed; If the value of the goods is not less than 10,000 yuan, a fine of not less than 10 times but not more than 20 times the value of the goods shall be imposed; If the circumstances are serious, the license shall be revoked:
(a) the production and marketing of pathogenic microorganisms, pesticide residues, veterinary drug residues, biological toxins, heavy metals and other pollutants and other substances harmful to human health content exceeds the food safety standard limits of food, food additives;
(2) producing food or food additives with food raw materials or food additives that have exceeded the shelf life, or dealing in the said food or food additives;
(3) producing or marketing foods that use food additives beyond the scope or in excessive quantities;
(4) The production or marketing of food or food additives that are spoilt, rancid, mildewed and infested with insects, unclean, mixed with foreign bodies, adulterated or with abnormal sensory properties;
(5) producing or marketing food or food additives with false production dates, shelf life or expiration dates;
(6) producing or marketing health food, formula food for special medical purposes, infant formula milk powder, or failing to organize production in accordance with the registered product formula, production technology and other technical requirements;
(7) The production of infant formula powder in sub-packaging, or the production of infant formula powder of different brands by the same enterprise with the same formula;
(8) The use of new food raw materials to produce food, or the production of new varieties of food additives, has not passed the safety assessment;
(9) Refusal of a food producer or trader to recall or stop its business after being ordered to do so by the food safety supervision and administration department.
In addition to the circumstances provided for in the preceding paragraph and in Articles 123 and 125 of this Law, whoever produces or markets food or food additives that do not conform to laws, regulations or food safety standards shall be punished in accordance with the provisions of the preceding paragraph.
Whoever produces new varieties of food-related products, fails to pass the safety assessment, or produces food-related products that do not meet the food safety standards shall be punished by the food safety supervision and administration department of the people's government at or above the county level in accordance with the provisions of the first paragraph.
