The sanctions committee of the Swiss Stock Exchange (SIX) has fined Swissquote Group Holding SA (Swissquote) 75000 Swiss francs for violating temporary advertising regulations.
SIX Exchange Regulatory Corporation (SER) is responsible for overseeing and enforcing securities trading regulations for listed companies. SER conducted an investigation into Swissquote on June 2, 2022, citing its special announcement on June 16, 2021 that "Thanks to outstanding growth, Swissquote is expected to set a record for half a year of performance".
SER believes that the temporary announcement issued by Swissquote on June 16, 2021 was not compliant due to technical issues and human error. About three hours after the temporary announcement, the push system delayed operation and violated multiple regulations.
After completing a thorough investigation, SER submitted a sanctions recommendation to the SIX Sanctions Committee. The sanctions committee decided on November 29, 2022 to impose a fine of 75000 Swiss francs on Swissquote. After Swissquote chooses not to appeal, the decision of the sanctions committee is legally binding.
When determining sanctions, the sanctions committee considers the degree of fault, the severity of the violation (characterized as' serious but not too serious'), and the sensitivity to sanctions.
